Rule 179 Property Subject of Specific Devise or Bequest

When a guardian sells or borrows against property that a person had planned to leave to someone in their will, the person who was supposed to receive that property does not lose their inheritance. Instead, they have a right to the money from the sale or loan in place of the original property.

The money must be tracked separately so it is clear how much belongs to the intended heir. This protects people who are named in a will from losing what they were promised just because a guardian had to sell or use the property while managing someone else's affairs.
