Rule 5 Presenting the Action for Decision

When you have a Social Security case in federal court, the judge decides the case by reading written arguments called briefs. There is no trial. Each side writes a brief explaining why they should win.

When you make a factual claim in your brief, you must point to the specific part of the court record that backs it up. You cannot just state something as fact without showing where that information comes from in the record.
