Rule 3.040 Computation of Time

When a deadline is mentioned in Florida's criminal court rules, the court follows a standard set of instructions for counting days on the calendar. These instructions come from a separate rule called Florida Rule of General Practice and Judicial Administration 2.514.

There is one exception to this. The short deadlines found in rules 3.130, 3.132, and 3.133(a) are not counted the same way. Those rules deal with things like first appearances and bail hearings, where the time periods are less than 7 days.
