Rule 3.115 Duties of State Attorney; Criminal Intake

When someone is accused of a crime in Florida, there is a formal process for handling that accusation from the start. The state attorney's office is responsible for setting up and running that intake process.

Any sworn complaint about a crime must be filed with the clerk of the circuit court. After that, it gets sent to the state attorney, who decides what happens next with the case.
