Rule 3.630 Sentence Before or After Motion Filed

A judge can choose when to hand down a sentence. It does not matter whether a motion for a new trial or a motion to throw out the judgment has been filed yet.

The judge has full flexibility here. They can sentence the defendant before either of those motions is filed, or they can wait until after. The timing is up to the judge.
