Rule 90.304 Presumption affecting the burden of proof defined

When you are involved in a civil case in Florida, some legal presumptions can shift the burden of proof from one side to the other. This rule covers the presumptions that are not already defined in Rule 90.303.

If a presumption affects the burden of proof, the other side must bring enough evidence to actually disprove the presumed fact. It is not enough to simply question it or raise a small doubt. The opposing party has to meet a higher bar to overcome it.
