Rule 90.409 Payment of medical and similar expenses

If someone pays your medical bills after an accident, or offers to pay them, that act cannot be used against them in court to show they were at fault.

For example, if a driver hits you and then offers to cover your hospital bills, a jury will never hear about that offer as proof the driver was responsible for the crash. The law treats paying someone's medical costs as a separate, kind act that has nothing to do with who caused the accident.

This rule exists so people feel free to help injured parties without worrying that doing so will hurt them in a lawsuit. Without this protection, someone might refuse to help pay for care just because they fear it would look like an admission of guilt.
