Rule 12.460 Continuances

If you need to delay a court hearing or trial, you must follow the general Florida court rules about continuances. A continuance means asking the judge to postpone a scheduled court date to a later time.

If you want to delay because a witness cannot be there, you must file a written motion explaining when you expect that witness to be available. Simply saying the witness cannot make it is not enough. You need to give the court a specific or estimated date when the witness can appear.
