Rule 2.130 Priority of Florida Rules of Appellate Procedure

When a case is being appealed in Florida, specific rules called the Florida Rules of Appellate Procedure take over and govern how everything works. This applies to the Supreme Court, district courts, and circuit courts when they are handling appeals.

If any other court rules conflict with the appellate rules during an appeal, the appellate rules win. Courts must follow them no matter what other rules might say something different.
