Rule 5.170 Evidence

When you are involved in a probate or guardianship case in Florida, the same evidence rules that apply in regular civil court cases also apply to your case. This means the standards for what can and cannot be presented as evidence work the same way as they would in most other Florida court proceedings.

There are some exceptions. If the Florida Probate Code, the Florida Guardianship Law, or the Florida Probate Rules say something different about evidence, those specific rules take over. In those cases, the special probate or guardianship rule would replace the regular civil evidence rule.
