Georgia Criminal Procedure (O.C.G.A. Title 17)

The statute that governs criminal proceedings in Georgia, from arrest through appeal, in twenty-two chapters. Georgia puts in its Code what many states put in rules of court, so this is where a criminal practitioner actually works: Chapter 4 is arrest, Chapter 5 searches and seizures, Chapter 6 bonds and recognizances, Chapter 7 pretrial proceedings, Chapter 8 trial, and Chapter 16 discovery. Chapter 3 sets the limitations on prosecution and Chapter 10 sentence and punishment. Chapter 12 is legal defense for indigents, Chapter 13 criminal extradition, and Chapter 17 the Crime Victims' Bill of Rights. Chapter 15 covers victim compensation and Chapter 15A compensation for criminally inflicted property damage. Chapter 20 governs identification procedures for live lineups, photo lineups and showups; Chapter 21 cold case murder reinvestigation; and Chapter 22 compensation for wrongful conviction and incarceration. Repealed chapters are published as such, so a citation in an older opinion still resolves.

Georgia Appellate Practice (O.C.G.A. Title 5, Chapter 6)

The Appellate Practice Act and the general provisions that surround it — the statute that decides how a case reaches the Supreme Court of Georgia or the Court of Appeals, and whether it may. Section 5-6-34 lists the judgments from which an appeal may be taken directly, and section 5-6-35 the cases in which an application for discretionary appeal is required instead; getting that choice wrong is jurisdictional, and between them those two sections decide it. Section 5-6-37 governs the notice of appeal and section 5-6-38 the cross appeal, section 5-6-39 extensions of time, and section 5-6-39.1 the out-of-time appeal. Sections 5-6-40 to 5-6-44 cover the enumeration of errors and the record and transcript on appeal, and section 5-6-45 supersedeas in criminal cases. Article 1 adds the appellate courts' own practice: costs, the form and entry of decisions, the remittitur, and the disposition of a case where a party dies pending appeal.
