Rule 13 Motions for Attorneys’ Fees and Costs

If you're an attorney and you want to be paid fees and costs for handling a child protective appeal, you need to ask for it within 14 days after all the briefs in the case are turned in. You can't wait longer than that.

Your request also has to follow specific formatting and documentation rules. These are laid out in Rule 39(d) of the Hawai'i Rules of Appellate Procedure, along with Forms 7 and 8 that go with it. Basically, you can't just ask for money in a vague way. You need to back up your request with proper paperwork that shows what you did and what it cost.

The main point here is timing and paperwork. Miss the 14 day deadline or skip the required forms, and you risk not getting paid for your work on the case.
