Rule 1 Classification of Proceedings

Hawaiʻi's circuit courts sort every case into a specific category before it moves forward. These categories include civil cases, criminal cases, probate matters, guardianships, conservatorships, trusts, family court matters, and mechanic's and materialman's lien cases (which involve unpaid construction or repair work).

If a case does not fit neatly into one of these listed categories, it gets placed under "special proceedings." This covers things like mandamus (asking a court to order someone to do their legal duty), habeas corpus (challenging unlawful detention), quo warranto (questioning someone's right to hold a public office or position), and prohibition (asking a higher court to stop a lower court from acting beyond its authority).

For people involved in a case, this classification system matters because it determines which rules and procedures apply. Sorting cases this way also helps the court system stay organized and helps judges, clerks, and attorneys know what to expect from the start.
