Rule 28 Board’s Role in Cases of Resignation in Lieu of Discipline or Disbarment by Consent.

When a lawyer wants to give up their law license instead of going through a discipline case, they have to file a sworn statement called an RSCH 2.14 affidavit. This rule explains what happens to that statement once it reaches the Disciplinary Board.

The Board Chairperson looks over the affidavit first. If it's filled out correctly and meets the requirements, the Chairperson tells Counsel to file it with the Hawaiʻi Supreme Court right away. The Supreme Court then reviews it and issues an order, which usually means accepting the lawyer's resignation or disbarment.

If the affidavit has problems or is missing something it needs, the Chairperson sends it back to the lawyer. The Chairperson also explains what's wrong with it, so the lawyer knows what needs to be fixed before trying again.
