Rule 114 Dismissal of Actions.

If you filed a family court case and later want to drop it, you can't just cancel it on your own. You have to ask the court for permission first. This means filing a motion along with a sworn statement (called an affidavit or declaration) explaining why you want to end the case. The court will look at your request and decide whether to approve it, and it can add conditions you must follow before the case is officially dismissed.

Once the judge signs off on the dismissal, you're not done yet if there's a parent involved in the case who doesn't have a lawyer and isn't set up to receive documents electronically through the court's JEFS system. In that situation, you must personally deliver a copy of the dismissal order to that parent, unless the court says you don't have to. This rule exists to make sure everyone involved in the case knows what's happening, especially parents who might not be getting automatic updates through the electronic filing system.
