Rule 14 Notation of Encumbrances

When a court issues a final decree about land, it has to spell out any encumbrances in full detail. An encumbrance is something like a lien, easement, or restriction that affects the property. The court can't just point to another document and say "see that paper over there." Everything has to be written out clearly in the decree itself.

However, there's an exception for transfer certificates of title. On these certificates, the court can reference an encumbrance by pointing to another document, but only if that document is actually on file with the assistant registrar of the land court. This means anyone looking at the certificate can go find the referenced document in the same office if they need more details.

The point of this rule is to make sure people can easily find out what affects a piece of land. If everything had to be spelled out on every document, records would get repetitive and hard to manage. But by requiring referenced documents to be on file in one specific place, the rule keeps things both simple and easy to check.
