Rule 69 Time Sharing Plans

If you want to set up a time-share plan in Hawaiʻi, the main document that creates the plan (called a declaration) needs to be recorded with the assistant registrar. This has to follow the standard recording rules that apply to other land documents, plus the specific requirements found in Hawaiʻi's time-share law, Chapter 514E.

However, once the time-share plan is set up, any later paperwork that transfers or affects individual time-share interests cannot be recorded with the assistant registrar. This applies whether the interest is a leasehold time-share or a fee simple time-share. So if someone buys, sells, or transfers a specific time-share interest after the plan is created, that transaction gets handled differently and won't go through this recording office.

In short, this rule draws a line between setting up the overall time-share plan and handling individual ownership changes within that plan. The initial setup gets recorded in this system, but individual transfers of time-share interests do not.
