Rule 117 Conservator’s Fees: Basis and Amount

A conservator is the person the court puts in charge of managing someone else's money or property when that person can't handle it themselves. This rule explains how much a conservator can get paid for doing that job.

Under this rule, a conservator can charge the same fees that trustees are allowed to charge under Hawaiʻi law (specifically, the fee schedule in Hawaiʻi Revised Statutes Section 607-18). This means the conservator doesn't need special permission to charge these standard fees. They can pay themselves out of the conservatorship estate, which is the money and property they're managing for the protected person.

However, the court can step in and order a different fee amount if needed. So while the standard trustee fee schedule is the default rule, a judge has the final say if there's a reason to charge more or less than that standard amount.
