Rule 2 Commencement of Action

To start a small claims case, you need to file a document called a "statement of claim" with the court clerk. This document lays out what you're asking for and why. Filing this paperwork is what officially begins your case.

You also have to file your case in the right location. The law decides which judicial circuit your case belongs in, based on things like where the dispute happened or where the other person lives. You can't just pick any courthouse. You need to file in the correct division within that judicial circuit, following the location rules already set out in Rule 3(c) of the District Court Rules of Civil Procedure.

If you file in the wrong place, it can cause delays or other problems with your case. So before you file anything, make sure you know which court and division is the right one for your situation.
