Rule 5 Place of Service

Here's what this rule means for people with a small claims case.

When someone files a small claims case, the other side needs to be officially notified through a process called "service." This rule says that notice papers usually have to be delivered to someone within the same judicial circuit where the court is located. In other words, you generally can't serve papers on someone who lives or is located far outside that court's local area.

There's one exception to this rule: subpoenas. A subpoena is a court order requiring someone to show up and testify or bring documents to a hearing. If a circuit judge signs off on it with the proper authority, a subpoena can be served anywhere in the state, even outside the court's usual local area.

This matters because it affects how and where you can get papers delivered to the other party in your case. If you're trying to serve someone who lives far away, you'll want to make sure you understand these limits, especially the difference between regular service and a subpoena.
