Rule 7 Jury Trial

If you want a jury to decide your small claims case, you have that option, but the case can't stay in small claims court. You need to ask for a jury trial before the trial date, and you'll need to pay the same jury fees that circuit court charges. Once you do this, your case moves out of small claims court and over to circuit court, where the jury trial will actually take place.

This means small claims court only handles cases where a judge decides the outcome. If you want your case heard by a jury instead of a judge, you have to be ready to pay the extra fee and go through the circuit court process, which may involve different rules and procedures than small claims court.
