Rule 2.7 Declarations

If a court rule says you need to swear to something under oath in writing, you have another option. You can use a written declaration instead, following the process laid out in Idaho Code Section 9-1406. This lets you certify that what you're saying is true without needing to go through a formal process with a notary.

This also means that anywhere the rules mention an "affidavit," that term includes these written declarations too. So if a form or rule calls for an affidavit, you can satisfy that requirement with a properly made declaration under Idaho Code Section 9-1406 instead of a traditional sworn affidavit. Both options carry the same legal weight in court.
