Rule 16 Vacating, Reconsidering, or Correcting Clerical Errors of a Judgment or Order

If you're in a treatment court program, this rule gives the judge some flexibility to fix mistakes and revisit certain decisions. First, it lets the judge correct simple clerical errors at any time, like typos or mistakes made by accident when paperwork was written up. This keeps the official record accurate.

The judge also has the power to change their mind about sanctions. If you received a penalty or sanction while in the program, the judge can later cancel it, reconsider it, or adjust it. This gives the court room to correct course if a sanction turns out to be too harsh or was based on incomplete information.

The most important part of this rule deals with being terminated from the program. Normally, criminal court rules limit how much time you have to challenge a court decision. But this rule creates a special exception for treatment court terminations. If you get kicked out of the program, you have 14 days from that decision to ask the judge to reconsider it. This gives you a real chance to explain your side or ask for another opportunity before the termination becomes final.
