Rule 363 Inspection of Original Exhibits on Appeal

If the appeals court thinks it needs to look at a physical piece of evidence from the original trial, it can order that item to be sent up for review. This might happen when a photo, document, or object was used at trial but was not included in the official written record sent to the appeals court.

The court will issue an order explaining how the item should be transported, kept safe, and returned after the court is done with it. The clerk of the appeals court is responsible for receiving and holding the item until the court says otherwise.
