Rule 406 Habit; Routine Practice

If a person always does something the same way, or a business always follows the same steps, that pattern can be used as evidence in court. For example, if someone always locks their car before going inside a store, that habit can be used to show they probably locked it on the day in question.

This is different from character evidence, which courts usually do not allow. Habits and routine practices are more specific and consistent than general personality traits, which is why the court treats them differently.

You do not need a witness who saw the action happen, and you do not need other supporting evidence to back it up. The habit or routine practice alone is enough to be considered relevant.
