Neutrals who help with alternative dispute resolution (like mediators) have to be paid in a fair, upfront way. They cannot charge a fee that depends on how the case turns out. Their payment has to stay the same no matter which side wins or what the final agreement looks like.
This rule also stops neutrals from paying or accepting kickbacks for sending business their way. A neutral cannot give someone money or a favor for referring clients to them, and they cannot accept that kind of payment either. This keeps the process honest and makes sure the neutral is only focused on helping people reach a fair resolution, not on making extra money through referrals or a specific outcome.
