If mediation or another dispute resolution process doesn't end with a written and signed settlement agreement, the people involved aren't stuck. They can still take their case to court, try another round of dispute resolution, or do both.
In other words, sitting down to work things out first doesn't take away anyone's right to go to court later. The only thing that actually locks in an agreement is having it written down and signed by everyone involved. If that doesn't happen, it's like the case is still open, and people can pick whatever path makes sense next, whether that's litigation or trying to resolve things another way.
