Rule 21.12 Sitting en banc or in panels
Organization of the Court of Appeals
Rule Text
The court of appeals may sit in panels. The chief judge of the court of appeals shall determine whether a case will be submitted with or without oral argument and whether it will be submitted to a panel of the court of appeals. A case first assigned to a panel may be submitted en banc upon the approval of the court.
