Rule 1.721 Common law preserved

If you need to preserve someone's sworn testimony before a lawsuit is filed, or in a situation not covered by the specific rules, the court still has the power to let you do that. The rules that come right after this one (1.722 through 1.728) spell out a process for preserving testimony, but they don't take away any other options the court already had under long-standing legal tradition.

In simple terms, this rule just makes sure that adding these specific procedures doesn't accidentally shut the door on other ways courts have always been able to handle these situations. So even if your case doesn't fit neatly into the steps described in the other rules, you may still be able to ask the court to help preserve testimony using its general legal authority.
