Rule 1.946 Effect of dismissal

If a case gets dismissed and that dismissal doesn't fall under rule 1.943, and it's not because the court lacked jurisdiction or the case was filed in the wrong location, then the dismissal counts as a final decision on the case. This means the court is treating it as if it fully decided the case on its actual facts and legal merits, not just on a technicality.

This matters a lot for what happens next. Once a case is dismissed this way, the person who filed it usually cannot bring the same claim again in a new lawsuit. The dismissal acts like a final judgment that settles the matter for good.

There's one exception built into the rule. If the dismissal order specifically says it does NOT count as a decision on the merits, then it won't have this final, case-closing effect. So the wording of the dismissal order matters. If you're involved in a case that gets dismissed, it's worth checking exactly what the order says about whether you can refile or not.
