Rule 1.956 Principal and surety; order of liability

If a court judgment involves two parties, a main person who owes the debt (the principal) and someone who backed them up (the surety), the judgment has to clearly spell out who pays first. The main person is responsible first, and the surety only has to pay if the main person doesn't.

The word "surety" covers anyone who is on the hook for someone else's debt in a backup role. This could be a co-signer, a guarantor, or anyone else whose responsibility only kicks in if the first person fails to pay. The court's written judgment needs to show this order clearly, so everyone knows who is supposed to pay first and who only pays if needed.

This matters because it protects the surety from being forced to pay before the main debtor has had a chance to pay. It also gives clear directions to anyone trying to collect on the judgment, so they know who to go after first.
