Rule 36.12 Continuances

If you want to postpone a scheduled hearing, you need a good reason. You can't just ask to push back the date without justifying it. You have to explain why in writing, and back up your explanation with a sworn statement (an affidavit) confirming the facts are true.

Timing matters too. Unless it's a real emergency, you must file your request to postpone at least seven days before the hearing is set to happen. Waiting until the last minute won't work unless something unexpected and urgent comes up.

If someone disagrees with the request to postpone, they need to speak up quickly. The rule expects objections to be filed promptly, not held back or delayed. This keeps the process moving and prevents one side from stalling the case without a valid reason.
