Rule 8.3 Child in need of assistance and termination proceedings

Both sides in a child in need of assistance case or a termination of parental rights case can use the same discovery tools that are used in regular civil court cases. This means they can request documents, ask written questions, and take depositions (formal interviews under oath) to gather information and evidence before the case goes to trial.

The rule prefers that people try to work things out informally first, rather than jumping straight to formal legal procedures. But when informal methods don't work, the formal civil court discovery rules step in to fill the gap.

This matters for parents, caregivers, and other people involved in these cases because it gives them a way to find out what evidence the other side has. It also lets them gather their own evidence and preserve testimony from witnesses, as long as doing so doesn't conflict with other juvenile court rules or laws that apply specifically to these types of cases.
