§ 60-221 Misjoinder and nonjoinder of parties.

If a lawsuit has the wrong parties mixed in, whether too many or too few, that's not a reason to throw the whole case out. Courts understand that sometimes people get added to a case who shouldn't be there, or someone who should be part of the case gets left out by mistake.

Instead of dismissing the case over this problem, the judge can fix it directly. The judge can add a person who needs to be part of the case, or remove someone who shouldn't be involved. This can happen because someone asks for it, or the judge can decide to do it on their own, without anyone requesting it. The judge just has to handle it fairly for everyone involved.

The judge also has the power to split up claims so they are handled separately. For example, if a case involves multiple claims against different people, the judge can separate one claim to be dealt with on its own, rather than lumping everything together. This gives courts flexibility to make sure cases involve the right people and get organized in a way that makes sense.
