§ 60-2504 Reopening proceedings.

If you were sued and the other side only notified you by publishing a notice in a newspaper instead of handing you papers in person, you may have missed the entire case without knowing about it. This rule gives you a way to ask the court to reopen your case if that happened to you.

The process for reopening the case follows the rules set out in K.S.A. 60-309. That law explains how much time you have to ask for a reopening and what you need to show the court. Generally, you have to prove you did not actually know about the lawsuit while it was going on, and you need to act within a set time limit after finding out.

Keep in mind that reopening a case does not automatically undo everything that happened. If someone else bought property or gained rights based on the original court decision, those rights may still be protected even after the case reopens. The rule mainly gives you a chance to be heard and defend yourself, not a guarantee that every part of the old decision will be erased.
