This summary is not the rule. The rule text controls.
Here's what this rule means for homeowners and contractors involved in construction disputes.
This law does not cover cases where someone got hurt or died because of a problem with the home. It also does not apply if the damage is so bad that the home cannot be lived in. Those situations are handled under other laws, not this one.
This law also does not cancel out or replace any warranties or promises already in a contract between a homeowner and a contractor. If the contract includes a written warranty, or if the law provides an automatic warranty on the work, those protections still apply. This law works alongside those existing rights, not in place of them.
In short, this law is meant for smaller construction defect issues, not injuries, deaths, or homes that are unsafe to live in. And it does not take away any warranty rights a homeowner already has under their contract.
