§ 22-2609 Property taken in one county and brought into another.

If someone steals property in one Kansas county and then brings that stolen property into a different county, prosecutors have a choice. They can bring criminal charges in the county where the theft or robbery actually happened, or they can bring charges in the county where the stolen property ended up.

This rule exists because stolen goods often cross county lines after a crime. Without this rule, it might be unclear which county's court should handle the case, especially if the thief only passed through one county briefly but stayed in another with the stolen items. This gives prosecutors flexibility to file the case where it makes the most practical sense, such as where evidence is located or where witnesses live.

For someone accused of theft or robbery, this means you could face charges in a county other than where you allegedly took the property. If you're arrested with stolen goods in a county different from where the theft occurred, don't assume the case will automatically be handled in the original county. Either location has legal authority to prosecute the case.
