§ 22-2711 Delivery of person in disobedience of K.S.A.

If a police officer is holding someone under a governor's warrant for extradition, that officer has to follow the rules in K.S.A. 22-2710 before handing that person over to the other state's representative. Those rules usually give the person a chance to challenge the extradition or get legal help first.

If an officer skips these steps on purpose and hands the person over anyway, the officer has broken the law. This is treated as a class B nonperson misdemeanor, which is a criminal charge against the officer. This rule exists to make sure officers don't rush someone out of state before that person has had a fair chance to fight the extradition through proper legal channels.
