§ 22-3905 Maintenance of a common nuisance.

If someone runs or helps run a "common nuisance" as defined by Kansas law, they can be charged with a crime. A common nuisance usually means a place that is used regularly for illegal activity, like drug use or sales.

This crime is a class A nonperson misdemeanor, which is the most serious type of misdemeanor in Kansas. Someone convicted can face jail time under the normal misdemeanor sentencing rules, and on top of that, the court can order a fine of up to $25,000. That fine amount is much higher than what you would normally see with a typical misdemeanor charge.

This rule works together with other related Kansas laws about common nuisances. It does not replace those laws. It just adds an extra layer of punishment and detail for anyone who is found to be maintaining or helping maintain a nuisance property.
