§ 22-4404 Application of habitual act.

This rule deals with what happens when someone is convicted of a crime after their case was resolved using a special process called the Agreement on Detainers. This agreement lets prosecutors quickly bring in a prisoner who is already locked up in another state or place, so they can face charges without long delays.

The rule says that just because a conviction happened through this faster detainer process, it does not automatically mean the person has to be sentenced under Kansas's Habitual Criminal Act. That act usually gives longer prison sentences to people who have prior convictions. This rule makes clear that using the detainer agreement to resolve a case does not by itself trigger those tougher habitual offender penalties.

In simple terms, this protects people from getting an automatic harsher sentence just because their case moved through the detainer system. Prosecutors and courts still have to look at each situation on its own to decide if the Habitual Criminal Act applies, rather than assuming it does just because of how the case was brought to trial.
