§ 22-4406 Delivery of person under terms of agreement.

This rule deals with what happens when a prisoner is wanted in another state for criminal charges under an agreement between states called the Interstate Agreement on Detainers. If that agreement requires a Kansas prison to hand over an inmate to another state, the person in charge of the prison (like a warden or superintendent) must do so.

The rule makes this a requirement, not something optional. Once the legal steps under the detainer agreement are followed, the prison official has no choice but to release the inmate to the other state so the case there can move forward.

For an inmate, this means that if another state has filed the right paperwork to request custody, the Kansas prison cannot refuse to hand them over or delay the process on its own. The transfer becomes a legal duty once the detainer process is properly triggered.
