§ 60-415 Inconsistent presumptions.

Sometimes a legal case involves two presumptions that point in opposite directions. When this happens, the judge has to decide which presumption makes more sense based on sound reasoning and fairness. The judge will pick the presumption that is better supported by logic and good policy, and that one will be used in the case.

If neither presumption is clearly stronger than the other, the judge will throw out both of them. In that situation, the case moves forward without either presumption playing a role, and the facts get decided based on the actual evidence presented instead.
