100.04 Confidentiality

When you go through mediation, the mediator has to keep what happens in those sessions private. This means anything you say or share during mediation stays confidential and cannot be shared with others outside the process.

There are some exceptions to this privacy rule, which are spelled out in a related rule (CR 99.11). Outside of those specific exceptions, the mediator must protect the confidentiality of everything discussed or disclosed during mediation.

This rule matters to you because it means you can speak openly during mediation without worrying that your words will be used against you later or shared with people who were not part of the mediation. It helps create a safe space where both sides can negotiate honestly and try to work out their differences.
