100.07 Separation of mediation from legal and other professional advice

A mediator's job is to help people work out their disagreement, not to act as anyone's lawyer or advisor. During the mediation, the mediator cannot give legal advice, even if they happen to be a lawyer in their regular job. They also can't give other kinds of professional advice, like financial or medical guidance, no matter what their background is.

This means if you're in mediation, you should not expect the mediator to tell you what your legal rights are or what decision is best for your situation. Their role is to help both sides talk through the problem and find a solution together, not to guide either person on what to do. If you need legal advice, you should talk to your own lawyer, either before, during breaks, or after the mediation session.
