12.05 Motion for more definite statement

If someone files a legal document against you, but it's written so unclearly that you can't figure out how to respond to it, you can ask the court to make them clarify it. This is called a motion for a more definite statement. You have to file this motion before you submit your own response, and you need to explain exactly what's confusing and what information you need to understand the claims against you.

If the judge agrees the document is too vague, the other side gets 10 days to fix it and file a clearer version. The judge can also set a different deadline if needed. If they don't fix it in time, the judge can throw out their unclear document entirely, or take whatever other action seems fair given the situation.

This rule protects you from having to guess what someone is accusing you of. You shouldn't have to respond to confusing legal claims. Instead, you can make the other side explain themselves clearly first, so you know exactly what you're dealing with before you have to answer.
