13.09 Separate trials; separate judgment

Sometimes a court decides to hold separate trials for different parts of a case, instead of dealing with everything at once. This rule says that if that happens, the court can still issue a final judgment on a counterclaim or cross-claim, even if the original claim that started the case has already been dismissed or resolved.

In simple terms, this means one part of a lawsuit does not have to wait on another part. If someone files a counterclaim (a claim against the person who sued them) or a cross-claim (a claim against another person on the same side of the case), that claim can move forward and reach a final decision on its own. It does not matter if the main claim in the case has already been thrown out or settled.

This gives courts flexibility to wrap up parts of a case as they are ready, rather than forcing everyone to wait until every single claim is resolved together. It also means that if your original claim gets dismissed, you are not automatically off the hook for a counterclaim someone filed against you. That counterclaim can still lead to a real judgment against you.
