23.06 Appeals

If a judge decides whether a lawsuit can move forward as a class action, either side can appeal that decision. But they need to act fast. The appeal has to be filed within 10 days after the judge's order.

Filing an appeal does not automatically stop the case from moving forward in the lower court. The trial can keep going while the appeal is pending, unless the trial judge or the Court of Appeals specifically orders a pause.

Once an appeal like this is filed, the appellate courts are supposed to handle it quickly rather than letting it sit for a long time. This helps make sure the class action question gets resolved without dragging out the whole case unnecessarily.
