28.01 Within the state

When someone needs to take a deposition in Kentucky for use in a Kentucky court case, the deposition has to be taken in front of an authorized person. This can be an examiner, a judge, a court clerk, a court commissioner, or an official court reporter. It can also be done in front of a notary public.

The rule also leaves room for other people to handle depositions if a separate law allows it. This means the list given here isn't the only option. As long as the person overseeing the deposition fits one of these categories or is otherwise approved by law, the deposition will count as properly taken and can be used later in court.
