34.03 Persons not parties

If you need documents, items, or access to land from someone who isn't part of your lawsuit, you still have options. This rule makes clear that you can file a separate, standalone lawsuit against that person just to get those documents, items, or land access, even though they aren't a party to your main case.

This matters because the usual discovery process in a lawsuit only works between the people already involved in the case. If someone outside the case has records you need, or you need to inspect their property, you can't just send them a normal discovery request. Instead, you have the right to start a new, independent legal action specifically aimed at getting that information or access.

In short, not being named in a lawsuit doesn't protect someone from having to hand over relevant documents or allow land access if there's a valid legal reason to get a court order requiring it.
