8.06 Construction of pleadings

Courts must read pleadings in a way that leads to a fair result, not in a way that lets small mistakes ruin a case. If someone files a complaint or answer that has minor wording problems or isn't perfectly organized, the judge should still look at what the person actually meant and try to reach a just outcome.

This rule protects people from losing their case over technicalities. For example, if you're representing yourself and don't use exact legal language, the judge shouldn't throw out your case just because you didn't phrase things the way a lawyer would. Instead, the court should look at the substance of what you're saying and treat it fairly.

The main idea is that court cases should be decided based on the real facts and real disputes between people, not on whether someone filled out paperwork perfectly. This gives everyone a fair chance to have their case heard, even if their legal writing isn't polished.
